Type of Data Processed and Purpose of Processing

In order to provide our services, we collect personal information (e.g. master data, contact data, payment data; browsing data) from you. The type of personal information we collect is the data that the data subject decides to provide to us in order to use our services - specifically: name; address; e-mail address; telephone number and in case of purchasing products on our e-commerce platform payment data - and browsing data.

Personal information provided by the data subject is used by the Data Controller for the purpose of:

  • To provide and manage services at the request of the user (e.g., through subscription to contact forms; through completion by the data subject of the purchase order for purchases on the e-commerce platform);

  • Respond to user requests (e.g., commercial requests; quotes, etc.);

    Making communications by various means (e.g., newsletter subscription at the request of the data subject);

  • Exchanging information aimed at the execution of the contractual relationship, including prior and subsequent activities (e.g., making online payments with different means of payment);

  • To comply with obligations under laws, regulations, or measures issued by public authorities.

 

Method of treatment

Users' personal data will be subject to processing operations in accordance with current legislation and the principles of fairness, lawfulness, transparency and confidentiality. Such data will be processed with and without the aid of electronic and computer tools. Users' personal data will be processed by the Data Controller and, if necessary, by the Data Processor and/or Data Processors. Users' personal data will not be subject to automated decision-making processes or any kind of profiling, except as provided in points 6 and 7 below.

 

Legal basis for processing

A) navigation on our website: Legitimate interest under Article 6(f) and Recital 47: processing is necessary for the purposes of pursuing the legitimate interests of the data controller or a third party, provided that the interests or the fundamental rights and freedoms of the data subject requiring the protection of personal data are not overridden, having regard to the reasonable expectations of the data subject based on his or her relationship with the data controller. Activities strictly necessary for the operation of the site and the provision of the browsing service on the platform.

B) Completion of forms on our site to collect user requests: Execution of pre-contractual measures and/or execution of a contract taken at the request of the data subject ex art. 6(b) and recital 44; consent of the data subject ex art. 6(a) and recitals 42 and 43.

C) completion of the purchase order on the e-commerce platform (online purchase and sale contract): performance of a contract to which the data subject is a party or performance of pre-contractual measures taken at the request of the data subject ex art. 6(b) and recital 44; consent of the data subject ex art. 6(a) and recitals 42 and 43.

 

Personal Data

Personal data, means: any information relating to a natural person, identified or identifiable, even indirectly, by reference to any other information, including a personal identification number; personal data that allow direct identification of the person concerned.

 

Navigation data

The computer system responsible for the operation of this website acquires during normal operation some personal data of the user whose transmission is implicit in the use of Internet communication protocols. This is information that is not collected in order to be associated with identified interests, but which by its very nature could, through further processing and association with data held by third parties, allow users to be identified. This category of data includes: the IP addresses or domain names of the computers used by users who connect to the site; the URI (Uniform Resource Identifier) rotation addresses of the requested resources; the time of the request; the method used in submitting the request to the server; the size of the file obtained in response; the numerical code indicating the status of the response given by the server (e.g. error, successful, etc.) and other parameters relating to the user's operating system and computer environment. The user's personal data may be disclosed, for the purposes set forth in Section 2 of this policy, to the following categories of entities:

Individuals in the above categories act as Data Controllers, or operate completely independently as separate Data Controllers.

 

Data recipients

The data subject's personal data will not be disclosed to third parties and unspecified parties in any form (e.g., consulting the data, making the data available).

 

Data Transfer

Personal data collected by us for the purposes described in this Notice will be disclosed and transferred to companies and individuals located in other countries belonging to the European Union or in countries outside the E.U.

The possible transfer of data to companies and/or third parties located in countries outside the E.U. is always put in place within the limits and conditions provided for in Art. 44 et seq. EU Reg. 2016/679 (GDPR).

The data subject may then obtain a copy of the conditions underlying the transfer by submitting a request to the Data Controller by e-mail to info@mani.boutique or by sending missive to the company's registered office.

 

Storage time of collected data

The Data Controller will process the personal data collected for as long as necessary to fulfill the purposes set out in point 2 of this policy. Thereafter, the data subject's personal data will be retained, and not further processed, for a period of time that may vary significantly depending on: purposes pursued, type of data processed, legal obligations (e.g. fiscal, administrative, etc.). In any case, should it no longer be necessary to retain said data, it will be deleted/destroyed in accordance with the GDPR.

 

Rights of the data subject to the processing of personal data

The data subject at any time may ask the Data Controller to exercise the following rights: art. 15 (right of access), art. 16 (right to rectification), art.17 (right to erasure), art. 18 (right to restrict processing), art. 19 (obligation to notify in case of rectification or erasure of personal data or restriction of processing), art. 20 (right to data portability) and 21 (right to object), art. 22 (automated decision making and profiling) of the GDPR, may at any time request access to and rectification or erasure of personal data or restriction of processing or to object to their processing, in addition to the right to data portability, by submitting written notice to the Data Controller. The data subject may lodge a complaint with the Italian Data Protection Authority www.garanteprivacy.it. The data subject also has the right, under Article 34 GDPR, to receive notice from the Data Controller, without undue delay, of any personal data breaches likely to present a high risk to the rights and freedoms of natural persons.

 

Ways of exercising rights

The interested party may at any time exercise the rights referred to in this statement and in general what is provided for in the GDPR regulations: (I) by sending a registered letter a/r to the Data Controller at the Company's Registered Office located in 07100 - Sassari, Via Roma n.28 or (II) by sending an email to the email address info@mani.boutique.

 

Consent to data processing

Pursuant to and in accordance with Art. 6(1)(a) of the GDPR, the data subject manifests consent to the processing of his or her personal data within the scope, for the purposes and in the manner referred to above. This consent is to be considered valid until revoked in writing to be received in the manner described in the preceding point.
